KEY REASON FOR DENIAL IS THE APPROVAL WAS GRANTED BASED ON SB743 AS SUPERCEEDING PUBLIC SAFETY ISSUES.
The California Environmental Quality Act (CEQA) and SB 743 are not intended to repress public safety. Issues of life and public safety rise above the scope of CEQA and SB743. We believe that the commission was misguided in their understanding of how SB743 is implemented. A review of the hearing and discussion among the commissioners will reveal how they actually sympathize with our position and would have supported our cause but they stated “their hands were tied by the state” because of SB743. There is no strong case that can be made wherein the state disregards public safety, imposing dangerous traffic conditions onto the community in order to promote an environmental cause. Public safety is expressly stated throughout the Hawthorne Municipal code as it pertains to the granting of a Conditional Use Permit and for that we are truly thankful. Now we plead with the city council to adhere to the public statements each one of the councilmembers made about public safety being your number one concern and deny the McDonalds drive-thru. People’s lives and the public's safety are riding on your decision.
1) Allow to CUP to proceed as approved
2) Allow CUP to proceed with certain changes
3) Overturn the approved CUP
4) Sent it back to planning to reassess design options
